Course Description

Arbitration introduces students to commercial arbitration and dispute resolution. Topics include commercial arbitration law, evidence introduction, bases for arbitration, and other alternative dispute resolution (ADR) methods. The course covers formal arbitration initiation, pre-hearing processes, jurisdiction, completion of hearings, mediation, and other ADR approaches. Emphasis is on international commercial arbitration as a private mechanism for resolving disputes, covering international investment and inter-state arbitration. Students explore fundamental principles such as the autonomy of the arbitration agreement, arbitrability, and impartiality of arbitrators.
