Course Description

M.Phil 580 Philosophy of Law explores two key themes in the philosophy of law: the relationships between the factual and the normative and between substance and method. In this course, students learn debates about the possibility of detachment in both substance and method, and the subtle relations between them – debates that have informed a substantial amount of theorizing in legal philosophy during the last century. Topics covered in this course include the theory of law, social rules at the foundations of law, the normativity of law, the role of morality in law, and the language of law. 

Learning Outcomes:

  • Critically analyze the two key themes in the philosophy of law.
  • Critically analyze and form conclusions about debates that have informed a substantial amount of theorizing in legal philosophy during the last century.
  • Learn and discuss major philosophers’ contributions to the philosophy of law.
  • Understand the role of language and interpretation in understanding the content of the law.
